Project Status: LAWA has obtained written FAA confirmation that the proposed phaseout of noisier aircraft ordinance would be grandfathered under the Airport Noise and Capacity Act of 1990 (ANCA) and not subject to that statute’s requirements (i.e., the analysis, documentation, and notice requirements implemented through Part 161) subject to inclusion of exemptions for Part 36 Stage 3 and 4 aircraft, as evaluated as Alternative 2 in the Final Environmental Impact Report (EIR) prepared under the California Environmental Quality Act (CEQA) for the noisier aircraft phaseout. The following correspondence documents LAWA and FAA consultation leading to this confirmation:
- December 11, 2008 letter from FAA to LAWA requesting information from LAWA and a meeting with LAWA regarding LAWA’s position that the proposed phaseout is grandfathered.
- February 3, 2009 LAWA response to FAA request for information and consultation regarding LAWA’s position that the proposed phaseout is grandfathered.
- March 19, 2009 letter from FAA to LAWA confirming that the proposed phaseout ordinance is eligible for a grandfather subject to inclusion of exemptions for Part 36 Stage 3 and 4 aircraft, as evaluated as Alternative 2 in the Final EIR for the noisier aircraft phaseout.
- May 11, 2009 report from City Attorney to the City Council transmitting draft phaseout ordinance to the City council for action.
- May 12, 2009 letter from Board of Airport Commissioners to the City Council requesting that the City Council certify the Final EIR and adopt the California Environmental Quality Act Findings, the statement of Overriding considerations, and the Van Nuys Airport Noisier Aircraft Phaseout Ordinance with Historic, Maintenance, and Stage 3 and Stage 4 Exemptions (known as Alternative 2 in the Final EIR).
